Request for Eligibility Review
After a DUI arrest, the officer will seize your driver’s license if you are accused of driving over the legal limit of .08 or if you refused the breath, blood or urine test. That administrative suspension will show up on your driving record shortly thereafter.
You only have one chance to contest this administrative suspension by demanding a formal review hearing within ten (10) days of your arrest. If you don’t get that notation removed, it will remain on your driving record for the next seventy-five (75) years.
At the Sammis Law Firm, our attorneys ALWAYS recommend demanding a formal review hearing. We can make the demand for you and help you secure a 42-day permit so that you can keep driving while we challenge the suspension. Before you decide, call our Tampa DUI Attorneys for a free consultation.

Don’t Waive the Formal Review Hearing
Some attorneys will tell you to waive all your rights and stipulate to the administrative suspension by requesting immediately reinstatement of your hardship privileges. To do this, you must enroll in DUI school and fill out the request for eligibility review form (HSMV 72034 (06/2017)).
You can download the form for the “request for eligibility review” (also known as the “wavier review hearing” or “review waiver hearing”) directly from the website of the Department of Highway Safety and Motor Vehicles.
